In September 1999, the EEOC district office in Seattle, Washington brought this suit against the H. Dahlby Company in the U.S. district Court for the Western District of Washington. The suit alleged that the defendant sexually harassed, retaliated against, and constructively discharged a male employee because of his sex in violation of Title VII of the Civil Rights Act of 1964. Six months after the defendant answered the complaint, the parties settled and a consent decree was entered in March 2000.
In the consent decree, the parties agreed that the defendant would pay the aggrieved male $39,000, refrain from retaliating and discriminating on the basis of sex, improve and strengthen its anti-discrimination policy, distribute the policy, implement a complaint procedure, provide a total of four hours of EEO training, post an EEO notice, and submit annual complaint reports. No fees or costs were awarded. The terms of the agreement ran for thirty-nine months.
