In September 2002, the Saint Louis District Office of the EEOC filed this lawsuit against CWI of Missouri, Inc., doing business as Heartland Disposal Services, and Republic Services, Inc. in the U.S. District Court for the Eastern District of Missouri. We do not have a copy of the complaint; therefore, the exact allegations are unknown. However, it appears from the consent decree that the complainant, a female employee, alleged sexual harassment and retaliation in violation of Title VII of the Civil Rights Act of 1964. The complainant intervened in the lawsuit in December 2002. Following some discovery and mediation, the parties settled the lawsuit in August 2003 through a consent decree.

The decree, containing an anti-discrimination and anti-retaliation clause, required the defendant to: certify compliance measures taken to the EEOC, provide a neutral reference to the complainant, post and distribute notice of employee rights, provide EEO training to all owners and employees in Missouri and the De Soto, IL area, and pay $75,000 to be distributed to the complainant and her attorney.
