The New York office of the EEOC brought this suit against Home Depot U.S.A., Inc. in the U.S. Court for the Eastern District of New York in September 2005. The complaint alleged that the claimant and a class of similarly situated employees were discriminated against because of their national origin and retaliated against in violation of Title VII of the Civil Rights Act of 1964. The New York office of the EEOC brought this suit against Home Depot U.S.A., Inc. in the U.S. Court for the Eastern District of New York in September 2005. The complaint alleged that the claimant and a class of similarly situated employees were discriminated against because of their national origin and retaliated against in violation of Title VII of the Civil Rights Act of 1964. More specifically, the complaint alleged that the defendant created a hostile work environment by harassing employees of West Indian origin which adversely affected their status as employees and retaliated against employees of West Indian origin who complained. Home Depot U.S.A., Inc. filed a motion for summary judgment which was denied, but the judge subsequently issued a stay in the suit. After the parties submitted numerous status reports, the EEOC filed a motion to dismiss the case with prejudice on April 3, 2008. The parties reached a settlement in March 2008, and the case was dismissed on April 22, 2008. The contents of the settlement agreement are unknown.
