In September 2001, the Miami District Office of the EEOC brought this lawsuit against Mortgage Information Services, Inc. in the U.S. District Court for the Southern District of Florida alleging discrimination on the basis of sex in violation of Title VII of the Civil Rights Act of 1964. Specifically, the complaint alleged that the defendant subjected the charging party, a female employee, to a sexually hostile work environment and retaliated against the charging party following her complaint …

In September 2001, the Miami District Office of the EEOC brought this lawsuit against Mortgage Information Services, Inc. in the U.S. District Court for the Southern District of Florida alleging discrimination on the basis of sex in violation of Title VII of the Civil Rights Act of 1964. Specifically, the complaint alleged that the defendant subjected the charging party, a female employee, to a sexually hostile work environment and retaliated against the charging party following her complaint of sexual harassment. The charging party intervened in the lawsuit in December 2001.

Following discovery and a partial grant of summary judgment for the defendant on all claims brought by the EEOC on behalf of other female employees other than the complainant, the case went to jury trial in September 2003. The jury returned a verdict for the defendant, and the court entered judgment for the defendants in September 2003. Thereafter, the intervenor-plaintiff appealed the district court judgment and the Court of Appeals dismissed the appeal. Then both the defendant appealed the District Court's refusal to sanction the EEOC and intervening plaintiff and award attorney's fees and costs. Following the District Court's granting of sanctions, affirmed by the Eleventh Circuit, the EEOC and intervenor plaintiff paid $26,921.60 to the defendant.
