In June 2003 the Phoenix District Office of the EEOC filed this lawsuit against airplane manufacturer Boeing Company and its Boeing Aerospace Operations in the U.S. District Court for the District of Arizona alleging discrimination on the basis of sex in violation of Title VII of the Civil Rights Act of 1964. We do not have a copy of the complaint; therefore, the exact allegations involved are unknown. However, it appears from the September 2005 Order that the complaint alleged that the defendant permitted the complaining party to be subjected to a sexually hostile work environment and retaliated against the complainant for opposing this practice. The complainant intervened in this lawsuit in September 2005. Following discovery, the defendants successfully moved for summary judgment in September 2005. The EEOC appealed the decision to the U.S. Court of Appeals for the 9th Circuit in December 2005, which dismissed the appeal for failure to file the opening brief in December 2006. Costs of $6,583.25 were taxed against the EEOC.

The appeal was then reversed and remanded in August 2008.  

Parties entered into a consent decree on February 3, 2010. The decree resolves all claims against the defendant, including back pay, compensatory and punitive damages, attorneys’ fees, costs, interest, and injunctive relief. Judgment is entered in favor of the plaintiffs for $100,000. Boeing, the defendant, is required to take action to ensure a work environment free from sex discrimination, including providing employee training, developing written policies and procedures, evaluating management, disciplining employees for violations, and promptly investigating complaints. The court retains jurisdiction over these actions for two years after the consent decree is filed. The case is now closed.
