In July 1997, the EEOC district office in Atlanta, Georgia brought this suit against International Longshoremen, Local 1423 in the U.S. District Court for the Southern District of Georgia. Although the complaint is unavailable, the consent decree states that eighteen aggrieved female employees alleged sex discrimination in violation of Title VII of the Civil Rights Act of 1964. The employees alleged that the defendant failed to offer job training and work assignments to females and males equally, thus affecting seniority rights. After relatively little discovery, the parties settled and a consent decree was entered in October 1998.

In the consent decree, the parties agreed that the defendant would refrain from retaliating or discriminating on the basis of sex, post EEO notices for one year, implement a "fair work selection" procedure, upgrade the seniority of the aggrieved employees, pay all of the aggrieved employees a $750 union initiation fee, pay all of the aggrieved employees a $5 per hour bonus for a three-year period, provide all union members with EEO training, and appoint an EEO consultant to carry out compliance.
