In April 1998, the EEOC district office in Charlotte, North Carolina brought this suit against Tar Heel Capital, Inc., doing business as Wendy's restaurant, an international fast food chain, and FFC Limited Partnership in the U.S. District Court for the Western District of North Carolina. The complainants, five former employees, alleged sexual harassment and retaliation in violation of Title VII of the Civil Rights Act of 1964. The aggrieved employees intervened in the case, and brought claims under state law as well; the defendant moved to dismiss these claims, but the motion was denied. In February 1999, the parties settled the case and a consent decree was entered. The decree is currently unavailable.
