On January 24, 2005, the Equal Employment Opportunity Commission ("EEOC"), on behalf of female social workers, filed a lawsuit in the Northern District Court of Indiana, under the Equal Pay Act as incorporated into the Fair Labor Standards Act, against School City of Hammond. The EEOC sought injunctive relief, compensatory damages, liquidated damages, and other forms of affirmative relief, claiming that the defendant paid its female social workers at a rate less than that paid to similarly situated males.
On October 26, 2005, the District Court (Judge Philip P. Simon) entered a consent decree where the defendant, among other things, agreed to pay the two female complainants a total of $27,000.
