In September 2000, the Los Angeles District Office of the EEOC brought this suit against Titanium Metals Corporation, Inc., d/b/a Timet, in the U.S. District Court for the District of Nevada alleging discrimination on the basis of sex in violation of Title VII of the Civil Rights Act of 1964. Specifically, the complaint alleged that the defendant subjected the charging party, a female employee, and other female employees to a sexually hostile work environment. In June 2001, the charging party intervened in the suit. After several discovery disputes, the parties participated in a settlement conference in early July 2002. The defendant filed several motions for summary judgment against each of the complainants. All of these motions were denied in December 2002. The defendant appealed these denials to the U.S. Court of Appeals; however, the appeal was dismissed because the parties settled in June 2003 through a settlement agreement.

The two-year agreement prohibited the defendant from discriminating or retaliating and required it to: transfer the charging party to a different department, expunge the personnel files of all the complainants, post a notice of the settlement agreement, provide sexual harassment training, report to the EEOC every six months, distribute its sexual harassment policy to its employees, and pay $170,000 to be distributed among six individuals.
