Case Summary

The Chicago District Office of the EEOC brought this action in the U.S. District Court for the Northern District of Illinois, against Primps L.L.C., d/b/a Supercuts, Inc. The complaint, filed in August 2005, alleged national origin discrimination in violation of Title VII of the Civil Rights Act of 1964; specifically that Defendant had discriminated against the charging parties based on their national origin, Hispanic, by maintaining a policy that required employees to only speak English. Two of the complainants intervened in November 2005.The parties entered a consent decree in October 2006. The decree, valid for one year, required Defendant to pay the three charging parties a total of $5,000 (individual amounts not disclosed in the decree), and enjoined Defendant from retaliating in violation of Title VII.The decree was entered in 2006 and scheduled to last until 2007. No further docket entries exist, so the case is closed.

32 March 29, 2006

MINUTE entry before Judge John W. Darrah : Currently before the Court is the defendant's motion for a protective order, which seeks to require plaintiff's counsel to submit to the Court and defendant's counsel certain proposed written communications with members of the plaintiff class. The Court may not exercise its power to prohibit communication with plaintiff class "without a specific record showing by the moving party of the particular abuses by which it is threatened." Gulf Oil Co. v. Bernard, 452 U.S. 89, 102 (1981), citing Coles v. Marsh, 560 F.2d 186 (3rd Cir. 1977). The defendant fails to meet this burden. Thus, the defendant's motion for a protective order is denied. Mailed notice (mjc, ) (Entered: 03/30/2006)
