In June 2003, the EEOC district office in Philadelphia, Pennsylvania brought this suit against Massaro Construction, Inc. in the U.S. District Court for the District of New Jersey. Although the complaint is currently unavailable, the consent decree states that a black male formerly employed by the defendant alleged retaliation for complaining of racial discrimination, in violation of Title VII of the Civil Rights Act of 1964. After the defendant's initial answer, the case was quickly settled and a consent decree was entered in March 2004.
The consent decree states that the defendant had to pay the aggrieved former employee $15,000 in satisfaction of all claims relating to this litigation, refrain from retaliating when it received complaints of racial discrimination, provide EEO training to all its staff, post EEO notices, expunge all of the aggrieved employee's employment records of any mention of this litigation, and issue a neutral reference letter.
