The Indianapolis office of the EEOC brought this action in the U.S. District Court for the Northern District of Indiana, against Mashiana Paradise Plaza, Inc. d/b/a Paradise Plaza Truck Stop. The complaint, filed in March 2004, alleged sex and pregnancy discrimination in violation of Title VII of the Civil Rights Act of 1964; specifically that Defendant discharged the charging party because she was pregnant. The parties engaged in a settlement conference in September 2004 and it was successful. In October 2004 a consent decree was entered and the case was dismissed.
The decree, valid for five years, required Defendant to pay the charging party $5,000, provide her with a neutral employment reference and expunge her employment records. Defendant was enjoined from discriminating or retaliating in violation of Title VII and required to post a notice of non-discrimination, provide Title VII training to its employees, and report regularly to the EEOC about any employees who were terminated during their pregnancy.
The terms of the agreement were to run for 5 years. The docket sheet does not show any further enforcement took place; the case was presumably closed in 2009.
