Case Summary

The Memphis District Office of the EEOC brought this action in the U.S. District Court for the Western District of Tennessee, against Dillard's Inc. The complaint, filed in September 1999, alleged retaliation in violation of Title VII of the Civil Rights Act of 1964; specifically that Defendant terminated the charging party in retaliation for complaining about race discrimination. Defendant moved for summary judgment in October 2000 but the motion was denied in February 2001. The parties then entered into a settlement agreement in March 2001. The decree required Defendant to pay the charging party a total of $8,500, expunge the charging party's employment record, post a notice of non-discrimination at its facility and provide Title VII training to its management level employees. The decree is in effect for whatever time is needed to provide the training and the individual relief.

ORDER Denying Defendant's Motion For Summary Judgment by Judge Julia S. Gibbons denying motion for summary judgment [92-1]; The EEOC has established all of the elements necessary for a "prima facie" case of retaliation; ... differential treatment of Anderson and other similarly situated employees at least allows for an inference that Anderson's conduct was insufficient to judtify her termination; When the record is considered in its entirety, w/all inferences drawn in favor of EEOC and Anderson, a reasonable jury could reject Dillards' explanation for its decision to terminate Anderson as mere pretext; Dillard's motion for summary judgment is denied; (cc: all counsel) (BAG) (Entered: 02/05/2001)
