The EEOC's St. Louis district office sued Bob Evans Farms, Inc., on May 20, 2004 in the U.S. District Court for the Eastern District of Missouri. The EEOC alleged that Bob Evans violated Title VII when it discriminated against at least three employees based on sex (female) by creating a hostile work environment which forced the constructive discharge of two employees. The one separately intervening complainant stipulated to the dismissal of her case on January 18, 2005. The EEOC and the defendant entered into a consent decree on January 19, 2005 which stipulated that Bob Evans would pay $250,000 in damages, fees and costs to be split among the eight claimants as determined by the EEOC; it would post a notice of compliance with Title VII; it would post EEO posters; conduct a training session for the employees at the restaurant where the harassment occurred; and semiannually report any complaints of harassment to the EEOC.

The decree was entered in 2005 and scheduled to last 2007. No further docket entries exist, so the case is closed.
