The Houston office of the EEOC brought this action against Insight Personnel Group Inc. and Insight Contracting Services. The complaint, filed in September 2000, alleged discrimination in violation of Title VII of the Civil Rights Act of 1964, the Americans with Disabilities Act and the Age Discrimination in Employment Act of 1967. Specifically, the complaint alleged that Defendant failed or refused to recruit and refer individuals for employment because of their race, color, sex, national origin, age and disabilities.
The parties agreed to resolve the dispute through a consent decree which was entered on the same day that the Complaint was filed in September 2000. The decree, which was valid for 3 years, included a non-discrimination provision, and in addition, a number of clauses detailing what information Defendant was allowed to record in its candidate database. Defendant was also required to provide the EEOC with copies of any applications or forms that would be used during the term of the decree. Defendant agreed to pay $175,000 to the class members.
