The EEOC's complaint alleged that the defendant violated Title VII when it discriminated based on race (African American) by creating a racially hostile work environment and retaliating by demoting employees, resulting in their constructive discharge. The parties entered into a consent decree on January 24, 2001, which stipulated that the defendant would pay the complainants up to $750,000 in damages, post a notice of compliance with Title VII, provide Title VII training to its managers and employees, establish an internal complaint procedure, improve supervisor accountability, appoint a Payment Agent to handle distribution of funds from the settlement fund, appoint a Consent Decree Administrator to determine claimant eligibility for monetary awards, and appoint a Consent Decree/Complaint Monitor who will ensure that the defendant is complying with the consent decree and make recommendations for improvements to the defendant.
