In September 2000, the Kansas City Area Office of the EEOC filed this lawsuit in the U.S. District Court for the Western District of Missouri alleging discrimination on the basis of sex, female, in violation of Title VII of the Civil Rights Act of 1964 and the Equal Pay Act. Specifically, the complaint alleged that the defendant paid claimant, a female employee, less than it did male employees performing the same job. After some discovery, the parties settled the lawsuit through a consent decree in June 2001.
The eighteen month decree, containing non-discrimination and non-retaliation clauses, enjoined the defendant from paying members of one sex more than the other sex to perform the same work and: post notice of employee rights, provide the EEOC with a written statement of compliance with the consent decree, provide a letter of recommendation for the complainant, and pay complainant $20,000 in backpay and compensatory damages.
