On June 21, 2007, the United States Equal Employment Opportunity Commission (EEOC) brought this suit against National Wholesale Liquidators, Inc. in the U.S. District Court for the Eastern District of New York. The plaintiff claimed that the defendant, a New York corporation that operated warehouse-style discount stores, engaged in several employment practices that violated Title VII of the Civil Rights Act of 1964. Specifically, EEOC said that one of the defendant’s store managers subjected employees to harassment and discrimination on the basis of race, national/origin, sex, and religion. The manager allegedly made offensive comments about and took retaliatory actions against employees who were female, Asian, of South Asian/Indian and Pakistani national origin, and/or Sikh. 

The parties entered discovery on October 11, 2007. On May 14, 2008, the plaintiff filed a motion for extension of time to complete discovery and referral to mediation. The court subsequently granted the motion. 

On October 23, 2008, the court issued a consent decree by which the parties agreed to resolve their dispute. The decree, which remained in effect for three years from the date of entry, explained that the defendant was enjoined from discriminating against any individual because of their race, national origin, sex, or religion, and from retaliating against any individual in connection with the decree. The decree also provided for systemic relief, which included mandating that the defendant post notice of the resolution of the dispute, adopt antidiscrimination policies, issue training to employees, and designate an EEOC officer, among other things. Finally, the consent decree required the defendant to pay a total of $249,000 in damages to the various employees connected to the action. The case is now closed.
