On November 18, 2020, a heterosexual woman over the age of 40 who worked as an administrator for the State of Ohio Department of Youth Services filed suit against her employer in the U.S. District Court for the Southern District of Ohio. Plaintiff claimed that on two occasions, she was passed over for a promotion in favor of a younger homosexual employee (one of whom was a man). She was also pressured to retire or transfer to another facility and was not thrown a party when she reached 30 years of service like one of her homosexual colleagues was. Plaintiff made claims under Title VII (gender and sexual orientation discrimination, hostile work environment, and retaliation), the Age Discrimination in Employment Act (ADEA), § 1983 (for a violation of her Fourteenth Amendment due process rights because she was not given a hearing before being transferred/demoted), and Ohio state law. Plaintiff was represented by private counsel. She sought injunctive relief (reinstatement and a bar of future discriminatory acts), compensatory damages, and attorneys’ fees. The case was initially assigned to Magistrate Judge Elizabeth Preston Deavers and later to Chief District Judge Algenon L. Marbley.

Plaintiff amended her complaint on May 21, 2021, to update the claim about retaliation. Defendant subsequently filed a motion for partial judgment on the pleadings on June 23, 2021. The motion suggested that the court lacked subject-matter jurisdiction on the ADEA and state law claims and that Plaintiff had failed to state a claim for the hostile work environment, retaliation, and due process claims. On March 29, 2022, Judge Marbley granted the motion. This was partially procedural: he held that because Defendant was a state agency and the state had not waived immunity on the ADEA and state law claims, federal court lacked subject matter jurisdiction. Furthermore, the Defendant was not a “person” for the purpose of § 1983. His ruling on the final two counts was more substantive. On retaliation, he held that Plaintiff had not engaged in any protected activity that would be subject to retaliation. He also found no evidence of harassment based on sexual orientation that would suggest a hostile work environment. After this order, Plaintiff’s only remaining claim was for gender and sexual orientation discrimination under Title VII.

In the meantime, the parties had engaged in extensive discovery. Defendant then moved for summary judgment on the remaining claim on June 10, 2022. Judge Marbley granted the motion on March 16, 2023. 2023 WL 2539214. His decision on the sexual orientation discrimination claim relied on the burden-shifting framework outlined in McDonnell Douglas (411 U.S. 792): a Plaintiff from a majority group alleging discrimination must, in addition to the prima facie case, show “background circumstances” that explain why the employer would discriminate against a majority group. Such circumstances could include that the decision-makers were members of a relevant minority group or that the employer has a statistical pattern of discrimination against that majority group. Here, Judge Marbley found that the decision-makers in both promotion situations were heterosexual and Plaintiff had shown no evidence of a pattern of discrimination (not receiving a party was not enough). In addition, he considered her gender discrimination claim in the one instance where she was replaced by a man, but found no evidence of a gendered motive.

Plaintiff appealed to the Sixth Circuit on April 13, 2023. A panel consisting of Judges Karen Nelson Moore, Senior Judge David W. McKeague, and Judge Raymond M. Kethledge affirmed the District Court’s ruling on December 4, 2023. 87 F.4th 822. The per curiam opinion conducted a de novo review of the case but, applying the “background circumstances” test, came to the same conclusions as the trial court. Judge Kethledge wrote a concurrence to suggest that although the “background circumstances” test was binding on the circuit, other circuits had rejected it and he would like to do the same.

On March 22, 2024, Plaintiff petitioned the Supreme Court to decide the “background circumstances” question. The Court agreed to hear the case on October 7, 2024, and oral arguments were held February 26, 2025. The Biden Department of Justice and Equal Employment Opportunity Commission filed an amicus brief in support of Plaintiff, arguing that Title VII should require the same evidentiary burden for all plaintiffs, regardless of their protected characteristic. 2024 WL 5184085. An Assistant to the Solicitor General also participated in oral arguments as an amicus curiae. As of March 2025, the decision was pending.
