Case Summary

In September 2006 the Phoenix District Office of the EEOC filed this lawsuit against Apothecary Shop of Gilbert, Inc. and Apothecary Shop of Scottsdale, Inc., doing business as Apothecary Shops of Arizona, in the U.S. District Court for the District of Arizona alleging discrimination on the basis of race, African-American, and gender, female, in violation of Title VII of the Civil Rights Act of 1964. Specifically, the complaint alleged that the complainant was terminated from her managerial position and replaced by a white male with a disciplinary history. The complaining party intervened in the lawsuit in August 2007. Following some discovery, the parties settled the lawsuit in April 2008 through a consent decree. The eighteen-month decree, containing anti-discrimination language, required the defendant to: make compliance reports, keep records, expunge the complainant's employment record and provide a neutral reference, post and distribute notice of employee rights, provide EEO training, implement a complaint resolution process, implement discipline and termination policies in a non-discriminatory manner, and pay $70,000 to the complainant as compensatory damages. The docket sheet shows that no further enforcement took place; the case was presumably closed in 2009.
