Case Summary

In July 2005, the Birmingham District Office of the EEOC brought this suit against Productivity Improvement Center, Inc. in the U.S. District Court for the Southern District of Mississippi alleging discrimination on the basis of sex in violation of Title VII of the Civil Rights Act of 1964. Specifically, the complaint alleged that the charging party, a female employee, was subjected to a sexually hostile work environment by her supervisor. The charging party intervened in the suit in February 2006. She filed a motion for default judgment which was denied in April 2006. After several discovery disputes, the parties settled in December 2006 through a consent decree. The two-year decree, containing non-discrimination and non-retaliation clauses required the defendant to: develop anti-discrimination policies and procedures, provide Title VII training to any employee who is assigned to work in Mississippi, provide the charging party with a neutral employment reference, and pay $285,000 to the charging party. In addition, the defendant agreed that if it opened a facility in Mississippi at any time during the decree, it would provide annual Title VII training for all employees of that facility and post and distribute its EEO policies in the facility. The docket sheet doesn't show any further enforcement took place; the case was presumably closed in 2008.
