The New Orleans District Office of the EEOC brought this suit against Coastal Fabrication LLC in September 2003 in the U.S. District Court for the Western District of Louisiana. The complaint alleged racial discrimination and retaliation in violation of Title VII of the Civil Rights Act of 1964. Specifically, the complaint alleged Coastal Fabrication LLC terminated the employment of an employee in retaliation for his wife's complaining that he had been discriminated against based on his race. The EEOC filed its complaint and a consent decree on the same day. The case was settled by entry of the consent decree just three days after the complaint was filed.
The decree included non-discrimination and non-retaliation clauses, required the development of a written Title VII policy, required the posting and distribution of the policy, and required the defendant to provide training regarding equal employment opportunity rights and responsibilities. Coastal Fabrications was required to keep records of race discrimination complaints and retaliation complaints under Title VII and make the records available to the EEOC. The injunctive parts of the decree had a three year term. The consent decree also required Coastal Fabrications to expunge the complainant's employment record and give him a neutral employment reference. In addition, Coastal Fabrication agreed to pay $10,000 to the complainant.
