Case Summary

In September 2006, the Dallas and San Antonio District Offices of the EEOC filed this lawsuit against Brentwood Healthcare Ltd. and Stebbins Five Companies, Ltd., in the U.S. District Court for the Northern District of Texas alleging discrimination on the basis of race and gender and retaliation in violation of Title VII of the Civil Rights Act of 1964. Specifically, the complaint alleged the defendant subjected the complaining parties to a racially and sexually hostile work environment, leading to the constructive discharge of one for opposing practices hostile to one complainant's association with an African-American, and to the constructive discharge of the other complainant. The complainants intervened in the lawsuit in December 2006. Following some discovery, the parties settled the lawsuit in March 2008 through a consent decree.

The two-year decree, containing an agreement not to discriminate, required the defendant to: make compliance reports, post EEO notice, provide EEO training, and pay $150,000 to the two complainants and their attorney. The docket sheet does not show any further enforcement; the case was presumably closed in 2010.
