In September 2000, the San Antonio District Office of the EEOC brought this suit against Capitol Anesthesiology Association in the U.S. District Court for the Western District of Texas. We do not have a copy of the EEOC's complaint. According to the intervenors' complaint, the EEOC alleged that the defendant violated Title VII of the Civil Rights Act of 1964 by discriminating against the charging parties, female employees, by refusing to give them a chance to apply for a promotion even though all of them were more qualified than the male applicant chosen for the job. The seven charging parties intervened in the suit in early April 2001. The EEOC and the defendant settled their claims in mid-August 2001 through a settlement agreement. The intervenors voluntarily dismissed their remaining claims against the defendant in late August 2001.
The settlement agreement between the EEOC and the defendant had a term of one year and prohibited the defendant from discriminating on the basis of gender. In addition, the decree required the defendant to: provide Title VII training for all its supervisory and managerial employees, report to the EEOC at specified intervals, and allow the EEOC to inspect its premises for purposes of verifying compliance with the agreement.
