In September 2003, the EEOC district office in Cleveland, Ohio brought this suit against S&Z Tool & Die Co., a tool & die manufacturer and distributor, in the U.S. District Court for the Northern District of Ohio. One African-American female who was denied hire intervened. The EEOC and intervenor's complaints alleged that S&Z repeatedly violated Title VII of the Civil Rights Act of 1964 and section 4112.99 of the Ohio Revised Code, respectively, when it refused to hire females for any other position than receptionist. The EEOC also alleged violations of race discrimination based on findings made while investigating the intervenor's initial sex discrimination claim. After only one case management hearing and two status reports, the parties settled the case and a consent decree was entered.
Per the consent decree, the defendant must (1) not discriminate on the basis of sex and/or race; (2) post Title VII notices conspicuously; (3) provide two hours of training for non-supervisory employees and four hours of training for supervisory employees; (4) employ an EEO Consultant to monitor the day-to-day Title VII compliance; (5) allow the EEOC to revise the defendant's current anti-discrimination policy; (6) pay intervenor $30,000 in satisfaction for her refusal to hire claim, $30,000 for attorney's fees and $60,000 for compensatory damages; and (7) pay $850,000 in a "Class Fund" to satisfy any future claims of unidentified (but at least 20) class members. The decree was to last for 39 months. The docket sheet doesn't show any further enforcement took place; the case was presumably closed in 2009.
