The Denver office of the EEOC brought this action in the U.S. District Court for the District of Colorado, against Vista Management Associates, Inc. The complaint, filed in November 2005, alleged sex discrimination and retaliation in violation of the Equal Pay Act of 1963. Specifically, the complaint alleged that the Defendant had paid the charging party and a class of similarly situated female Property Managers at a wage rate which was less than the rate paid to its male Property Managers for performing equal work, and that the Defendant had retaliated against the charging party for exercising her rights under the Equal Pay Act.
A consent decree was entered one week after the complaint was filed. The decree, which was valid for 3 years, provided for the Defendant to pay the charging party a total of $41,800 ($6,591 in back pay and $35,209 in liquidated damages)and provide her with a neutral employment reference; devise a new non-discrimination policy and post it in the office; and provide EEOC training for its employees. Defendant was also required to provide semi-annual reports regarding its compliance with the decree and any complaints of discrimination, and to maintain such records as payroll data, employee evaluations and discrimination complaints, for 2 years after the termination of the decree. The docket sheet doesn't show show any further enforcement took place; the case was presumably closed in 2008.
