In June 1999, the Tampa Area Office and Miami District Office of the EEOC filed this lawsuit against Rio Bravo International, Inc., Innovative Restaurant Concepts, Inc., and Applebee's International (doing business as Rio Bravo Cantina) in the U.S. District Court for the Middle District of Florida alleging discrimination on the basis of sex, female, in violation of Title VII of the Civil Rights Act of 1964. Specifically, the complaint alleged that the defendants maintained a hostile work environment, and retaliated against one complaining party by requiring them by subjecting them to adverse employment conditions and later forcible resignation. Mr. Robert Evans and Chevys, Inc. were later impled as third party defendants.

Following discovery and a jury trial, the jury found in favor of the EEOC and awarded the complainants $1,550,000. However, the amount was reduced to comply with the $300,000 statutory caps. Therefore, the actual amount of damages awarded is unknown.
