The Oklahoma City Area Office of the EEOC brought this action in the U.S. District Court for the Western District of Oklahoma, against Touchstar Americas and related businesses. The complaint, filed in May 2001, alleged national origin discrimination in violation of Title VII of the Civil Rights Act of 1964; specifically that the Defendant had subjected charging party to a hostile work environment and terminated him because of his national origin, Hispanic. In December 2002, the Defendant filed for summary judgment and the EEOC fild for partial summary judgment. In February 2003, Defendants motion was granted in part and denied in part, and the EEOC's motion was granted.

In March 2003 the parties entered into a consent decree. The decree was valid for two years and required Defendant to: pay charging party $25,000, expunge the charging party's employment record, provide the charging party with a neutral employment reference, provide semi-annual EEO training to its employees, post an anti-discrimination notice at its facility, and report to the EEOC regularly about its compliance with the decree. The Defendant was also enjoined from discriminating in violation of Title VII.
