The St. Louis District Office brought this action in the U.S. District Court for the Western District of Missouri, against Eaglepicher, Inc. The complaint, filed in September 2003, alleged sex discrimination and retaliation in violation of Title VII of the Civil Rights Act of 1964; specifically that Defendant had questioned the charging parties about their sex lives, followed them into the bathroom, threatened them, stalked them after work, and disciplined and discharged the female employees because of their sex.
In October 2003 the parties agreed to a consent decree which provided for a total payment of $200,000 (representing back pay with interest and compensatory and punitive damages) to be split among the 8 charging parties; reinstatement of some of the charging parties; restoration of some of the charging parties' seniority status, and an injunction against rehiring the culpable manager and supervisor. Defendant was also enjoined from discriminating on the basis for sex and from retaliation, and required to provide training on EEO laws for its managers and supervisors and to implement a policy prohibiting discrimination on the basis of sex or retaliation.
