Case Summary

In January 2003, the Seattle Field Office of the EEOC brought this lawsuit against United States Bakery, Inc. in the U.S. District Court for the District of Oregon. We do not have a copy of the complaint; therefore, the exact allegations are unknown. In January 2003, the Seattle Field Office of the EEOC brought this lawsuit against United States Bakery, Inc. in the U.S. District Court for the District of Oregon. We do not have a copy of the complaint; therefore, the exact allegations are unknown. However, it appears from the consent decree that the complaint alleged that the defendant subjected the complaining parties, female employees, to a sexually and radcially hostile work environment. The complainants intervened in July 2003. Following extensive discovery and the near completion of preparation for trial, the parties settled the lawsuit in July 2006 through a consent decree.

The three-year decree, containing non-discrimination and non-retaliation clauses, required the defendant to: have its legal counsel review complaints of retaliation and harassment, send compliance information to the EEOC regarding EEO training and employment policies, permit its legal counsel to monitor its compliance with the consent decree, expunge references to the complaints or litigation from complainants' employment records, post and distribute notice of employee rights, provide mandatory annual EEO training to all employees, implement a complaint resolution process and review and revise its policies against discriminatory employment practices. The intervenor complainants' claims were settled through a separate agreement. The docket sheet doesn't show any further enforcement took place; the case was presumably closed in 2009.

The parties shall call into the court's conference line (the phone number provided via separate email) five minutes prior to the scheduled conference time. The court will join the conference at or shortly after the appointed time. Local Rules 16-2(b) and 26-1(a)(b) require that counsel confer prior to the conference. At the conference, counsel should be prepared to discuss the status of the case, relevant dates and deadlines, and any other significant issues. If the parties plan on presenting a proposed schedule, it is helpful if they email that to the courtroom deputy by noon the day before the hearing. Ordered by Judge Marco A. Hernandez.
