The complaint alleged that Hispanic and Filipino employees were harassed on account of their race and/or ethnic origin and discriminated against with regards to assignments and promotion opportunities, in violation of Title VII of the Civil Rights Act of 1964. The parties settled by entry of consent decree in January 2008.

The decree included non-discrimination, non-retaliation, and non-harassment clauses and required the defendant to post and distribute an equal promotion policy, create a complaint procedure, and give its employees non-discrimination training. It also required defendant to report annually to the EEOC regarding complaints and promotions and to keep all relevant records. The consent decree is effective for three years. The docket sheet does not show any further enforcement took place; the case was presumably closed in 2011.
