In April 2004, the EEOC district office in Seattle, Washington brought this suit against the Union Pacific Railroad Company, a national railroad, and several individuals in the U.S. District Court for the Western District of Washington. A female complainant intervened in the case. The complaints alleged that the defendants violated Title VII of the Civil Rights Act of 1964 (sex). Specifically, the female claimed that she was subjected to inappropriate comments, pornography, and indecent exposure.

After a defense motion to dismiss for want of jurisdiction was denied, the parties settled. The EEOC consent decree states that the parties agreed that the defendant would pay the aggrieved party $260,000, refrain from retaliating and discriminating on the basis of sex, expunge the complainant's employment record of any reference to this litigation, would issue neutral references, distribute and post its anti-discrimination policy, provide three hours of EEO training, and submit semiannual compliance/complain reports to the EEOC. No fees or costs were awarded. The terms of the decree run for three years. The docket sheet does not show any further enforcement took place; the case was presumably closed in 2008.
