The EEOC's Minnesota district office sued the Episcopal Church Home of Minnesota, on September 9, 1999 in the U.S. District Court for the District of Minnesota. The EEOC's complaint alleged that the defendant violated Title VII when it discriminated based on race (African American) by transferring the complainant to an unfavorable position because of his race, submitting him to a hostile work environment, and terminating him in retaliation for his complaint. The parties entered into a consent decree on March 9, 2001, which stipulated that the defendant would pay the complainant $25,000 in damages, expunge the complainant's work record, provide a neutral letter of reference, post a notice of compliance with Title VII, provide Title VII training to its employees, draft (if not already implemented) and distribute a non-discrimination policy, distribute a notice to residents that discrimination is intolerable, certify that it is complying with the consent decree, allow the EEOC access to its premises to ensure compliance with the consent decree, and report complaints of racial harassment/discrimination to the EEOC semiannually.
