In September 2004, the Seattle District Office of the EEOC brought this suit against Central Park Lodges Long Term Care, Inc., d/b/a Linden Grove Health Care Center, in the U.S. District Court for the Western District of Washington. The complaint alleged that the defendant discriminated against the charging parties, employees in the defendant's residential care facility, on the basis of their race (African American, Hispanic or Asian American) by subjecting them to harassment, making race-based work assignments, and denying them promotions because of their race. In October 2004, seven charging parties intervened in the suit. After some scheduling orders, a proposed consent decree was submitted to the court for preliminary approval in January 2005, and the parties reached a final settlement in May 2005 through a consent decree. The three-year decree, containing non-discrimination and non-retaliation clauses, required the defendant to: revise and distribute its EEO policy, provide annual EEO training for all employees, post a notice of the settlement, report to the EEOC every six months, provide neutral references for the charging parties, expunge the charging parties' personnel files of all references to the charges of discrimination, and post job vacancies in a designated employee area. In addition, the defendant agreed to pay $270,000 to be divided among eight charging parties; $100,000 to establish a settlement fund; and $130,000 for the charging parties' attorneys' fees. The terms of the agreement were to run for 3 years. The docket sheet does not show any further enforcement took place; the case was presumably closed in 2008.
