The complaint was filed under Title VII of the Civil Rights Act of 1964 and Title I of the Civil Rights Act of 1991. Complainant alleged that Defendant refused to promote employees who were not members of the Church of Jesus Christ of Latter-Day Saints and/or who were black. The EEOC additionally alleged that Defendant subjected this class of individuals to unfavorable terms and conditions of employment and allowed a hostile work environment to develop.After extensive discovery, in February 2005 the parties filed a motion for entry of consent decree. The consent decree was entered on March 8, 2005 and has a duration of 36 months. The defendant agreed to pay $65,000, to be divided among the four named complainants. The defendant additionally agreed to post notice of EEO rights, provide training, expunge the complainant's employment record and prepare an apology letter. The training would be given to all supervisory employees and would take the form of a live seminar, to be offered each year, for three years. The docket sheet shows that no further enforcement took place; the case was presumably closed in 2008.

Present telephonically are Michelle Marshall and Sandra Padegimas for Plaintiff and Neil Alexander and Kristin Culbertson for Defendant. Discussion is held regarding Plaintiff's objection to disclosure of non-mental health providers for Ms. Chaussee. Plaintiff stipulates that it will not seek any economic damages for Ms. Chaussee. The Court orders as follows: 1. Plaintiff shall supply to defense counsel by Monday, October 18, 2004, the names of Ms. Chaussee's non-mental health providers or any other health care providers not previously identified, for the last six years; 2. defendant may subpoena directly from those health care providers the medical records of Ms. Chaussee for the the last six years; 3. only counsel may review the medical records; 4. if counsel for the defendant is of the view that there is information relevant to the emotional distress damages sought with respect to Ms. Chaussee, counsel for defendant shall confer with counsel for the plaintiff about the appropriateness of further discovery of either plaintiff or the medical providers about those services; 5. if counsel are unable to agree regarding further discovery, counsel may request the Court to schedule a hearing.
