The defendant operated a car dealership in Bellingham, WA. The lawsuit was filed at the United States District Court for the Western District of Washington (Seattle) on 01/15/2003. EEOC alleged on behalf of a former female employee that she was subject to a sexually hostile work environment and was constructively discharged due to lack of corrective measures from the defendant.

The individual complainant intervened in the EEOC lawsuit, alleging violation of the Washington state anti-discrimination statute as well as Title VII.

The parties reached a settlement agreement at a voluntary mediation conference on 02/12/2004. A consent decree was entered into judgment on 03/08/2004.

Under the four-year consent decree, the defendant agreed to pay the individual complainant $70,000. The defendant also agreed to expunge the individual's personnel record and provide neutral reference for her in the future. The consent decree additionally required the defendant to develop anti-discrimination policies and retain an independent sexual harassment consultant to conduct internal review and audit. The defendant would also need to post a notice of the lawsuit and provide annual training to its employees. The docket sheet does not show any further enforcement; the case was presumably closed in 2008.
