A private plaintiff brought this case against New Prime, Inc., a trucking company, in the U.S. District Court for the Western District of Missouri in March 2001. The case was consolidated with a suit brought by the EEOC in August 2001. Two other complainants intervened in this case. The defendant filed several motions to dismiss, which were denied. The court entered injunctive relief in December 2003. This included providing a neutral reference for and expunging the employment record of the complainant; conducting sexual harassment training to all employees; issuing yearly reports to the EEOC stating that training was conducted; and posting a notice of employment rights.
