In November of 2004, the EEOC district offices in Chicago and Los Angeles brought suit in U.S. District Court, Northern District of California, against Abercrombie & Fitch, a nationwide clothing retailer. The complaint alleged that the company violated Title VII of the Civil Rights Act by carrying out a pattern or practice of discrimination in hiring and promotion on the basis of sex, race, color, and national origin.

The case was consolidated with two class action suits brought by private plaintiffs (Gonzalez v. Abercrombie & Fitch, Case No. 03-2817 and West v. Abercrombie & Fitch, Case No. 04-4730). The case was settled, and a consent decree was given final approval by the court in April of 2005. Under the terms of the consent decree, Abercrombie agreed to pay more than $40 million into a settlement fund. The decree (the duration of which is six years) also provided for extensive injunctive relief, and Abercrombie is required to create an "Office of Diversity" to ensure that the company's hiring procedures and marketing materials reflect an appropriate racial and gender balance. The settlement additionally requires Abercrombie to submit compliance reports. The EEOC, along with the private plaintiffs' counsel and a Special Monitor appointed by the Court, are required to work closely with the company to oversee its compliance with the decree.

The consent decree was set to expire on April 14, 2011, but the plaintiffs sought an extension of the decree. The court ruled on April 6, 2011 that the decree would remain in effect until the court ruled on any appeals of the Special Master's orders on Motion for Resolution of Enforcement Proceedings. After the Special Master's order was issued, the plaintiffs appealed it, but it was affirmed by the court on June 23, 2011. As a result, presumably the consent decree ended in June 2011. Abercrombie submitted an expert report in March 2012, and as there is no further activity on the docket, presumably the case closed in 2012.
